1. Introduction
These Website Standard Terms and Conditions written on this webpage shall manage your use of this website. These Terms will be applied fully and affect your use of this Website. By using this Website, you have agreed to accept all terms and conditions written in here. You must not use this Website if you disagree with any of these Website Standard Terms and Conditions.
Minors or people below 18 years old are not allowed to purchase on this Website.

Under these Terms, KR Custom Services and/or its licensors own all the intellectual property rights and materials contained in this Website.
You are granted limited license only for purposes of viewing the material contained on this Website.
3. Restrictions

- Selling, sublicensing and/or otherwise commercializing any Website material;
- Publicly performing and/or showing any Website material;
- Using this Website in any way that is or may be damaging to this Website, or KR Custom Services;

- Using this Website contrary to applicable laws and regulations, or in any way may cause harm to the Website, or to any person or business entity;

Certain areas of this Website are restricted from being accessed by you and KR Custom Services may further restrict access by you to any areas of this Website, at any time, in absolute discretion. Any user ID and password you may have for this Website are confidential and you must maintain confidentiality as well.
4. No warranties
This Website is provided “as is,” with all faults, and KR Custom Services express no representations or warranties, of any kind related to this Website or the materials contained on this Website. Also, nothing contained on this Website shall be interpreted as advising you.
5. Limitation of liability
In no event shall KR Custom Services, nor any of its officers, directors and employees, shall be held liable for anything arising out of or in any way connected with your use of this Website whether such liability is under contract. KR Custom Services, including its officers, directors and employees shall not be held liable for any indirect, consequential or special liability arising out of or in any way related to your use of this Website.
6. Indemnification
You hereby indemnify to the fullest extent KR Custom Services from and against any and/or all liabilities, costs, demands, causes of action, damages and expenses arising in any way related to your breach of any of the provisions of these Terms.
7. Severability
If any provision of these Terms is found to be invalid under any applicable law, such provisions shall be deleted without affecting the remaining provisions herein.
8. Variation of Terms
KR Custom Services is permitted to revise these Terms at any time as it sees fit, and by using this Website you are expected to review these Terms on a regular basis.
9. Assignment
KR Custom Services is allowed to assign, transfer, and subcontract its rights and/or obligations under these Terms without any notification. However, you are not allowed to assign, transfer, or subcontract any of your rights and/or obligations under these Terms.
10. Entire Agreement
These Terms constitute the entire agreement between KR Custom Services and you in relation to your use of this Website and supersede all prior agreements and understandings.
11. Governing Law & Jurisdiction
These Terms will be governed by and interpreted in accordance with the laws of the State of Qld, and you submit to the non-exclusive jurisdiction of the state and federal courts located in Qld for the resolution of any disputes.

12.1 Definitions
In the terms and conditions:
“Dispatch Date” means the date the eGift Voucher was emailed to the Recipient of the eGift Voucher.
“eGift Voucher” means a Gift Voucher issued in ‘electronic’ form as described in these terms and conditions.
“Expiry Date” means the use by date of the Gift Voucher, which is three (3) years if purchased on or after 01 Dec 2019
“Recipient” means the person who receives the Gift Voucher as the case may be (and for the avoidance of doubt may be the same as the purchaser).
“Redeem” means to reduce the value loaded on your Gift Voucher by using the Gift Voucher to purchase goods or services, and “Redeemable”, “Redeemed” and “Redemption” have corresponding meanings.
“Website” means krcustomservices.com
“Gift Voucher” means an eGift Voucher:
A reference to “we”, “us” or “our” is a reference to KR Custom Services.
A reference to “you” or “your” is a reference to the person who is taken to agree to these terms and conditions under clause 2.
12.2 Agreeing to the terms and conditions
12.2.1 These terms and conditions apply to each Gift Voucher.
12.2.2 You agree to be bound by these terms and conditions by purchasing, activating, using or attempting to use a Gift Voucher, or by making a transaction enquiry or exercising any right to Redeem value loaded on a Gift Voucher.
12.2.3 By purchasing, activating, using or attempting to use a Gift Voucher, or by making a transactions enquiry or exercising any right to Redeem value loaded on a Gift Voucher, you warrant to us that you will comply with these terms and conditions and all applicable laws and that the Gift Voucher will not be used in any manner that is unlawful, misleading, deceptive, unfair or otherwise harmful to consumers.
12.2.4 If you are giving a Gift Voucher to another person, you should ensure that he or she is aware of the terms and conditions that apply to the WISH Gift Card and the relevant Expiry Date of the Gift Voucher.
12.3 Purchasing a Gift Voucher
12.3.1 Physical Gift Voucher can be purchased from the studio of KR Custom Services.
12.3.2 eGift Voucher can only be purchased online at the Website.
12.3.3 When purchasing Physical Gift Voucher from the Studio of KR Custom Services, payment can be made via cash, EFTPOS or credit card.
12.3.4 When purchasing Physical Gift Vouchers or eGift Vouchers online, payment can be made using a credit card, via EFT direct deposit. Payment is required (including payment clearance) prior to the Gift Voucher being dispatched.
12.4 Loading value onto a WISH Gift Card
12.4.1 A minimum of $10 and a maximum of $500 can be loaded on each Gift Voucher from KR Custom Services Studio, at the point of sale via cash, EFTPOS or credit card payment.
12.4.2 At our absolute discretion, we may change the minimum and maximum amounts that can be loaded on Gift Vouchers. If we decided to do this, we will publish details on our Website.
12.4.3 Your Gift Voucher is valid for use until the Expiry Date.
12.4.4 Your eGift Voucher is valid for use until the Expiry Date.
12.5 Redeeming your Gift Voucher or eGift Voucher
12.5.1 Your Gift Voucher can be Redeemed for goods and services from KR Custom Services up to the value loaded onto your Gift Voucher. Value Redeemed is deducted from the Card Balance.
12.5.2 Gift Voucher can be used for online purchases at krcustomservices.com
12.5.3 Gift Vouchers cannot be refunded or used to obtain cash.
12.5.4 Resale of Gift Vouchers is strictly prohibited, except with our prior written consent. If approved, Gift Vouchers cannot be resold for more than the original purchase price. Gift Vouchers that are resold in breach of this clause 6.7 will be invalid with the result that purchases of those cards will not be able to use or Redeem unspent value on their Gift Vouchers.
12.5.5 Your use of the Gift Voucher at KR Custom Services is subject at all times to the policies (and, where applicable, other terms and conditions) of KR Custom Services regarding the goods and services made available by it. For example, if you are under the age of 16 years, your Gift Voucher cannot be Redeemed for products without a consenting guardian being present for any massage sessions.
12.5.6 Where the price of the goods or services being purchased with the Gift Voucher exceeds the Card Balance, you must pay the amount in excess of the Card Balance by an alternative payment method at the discretion of KR Custom Services.
12.5.7 Once your Gift Voucher has reached its Expiry Date, any unspent value cannot be used or Redeemed by you.
12.5.8 Once your Gift Voucher has reached a nil balance it cannot be re-activated.
12.5.9 The Redemption of Gift Vouchers is restricted to the purchase of standard retail quantities of goods.
12.6 No Recharging of the Gift Vouchers
12.6.1 After a Gift Voucher has been activated you cannot subsequently add value to it.
12.7 Transaction enquiries
12.7.1 You can check your Gift Voucher transaction history and Card Balance by requesting in writing to accounts@krcustomservices.com and they will respond with your Card balance.
12.7.2 To make a balance enquiry on your Gift Voucher as set out in clause 7.1, you must provide your Card Number and full name.
12.8 Lost or Stolen Gift Vouchers
12.8.1 You must treat your Gift Voucher like cash. If your Gift Voucher is damaged, lost or stolen, please contact us via the Website, Facebook or email at accounts@krcustomservices.com. However we have no obligation to replace or refund value for damaged, lost or stolen or deleted Gift Vouchers except where we have breached any condition or warranty implied under consumer protection legislation that cannot be excluded in these terms and conditions (for example warranties as to the exercise of due care and skill in providing services and as to fitness for purpose of materials we provide).
12.8.2 We reserve the right to place a stop on your Gift Voucher if: 12.8.2.1 you report that your Gift Voucher has been lost, stolen, damaged or deleted;
12.8.2.2 we believe (or reasonably suspect) that you have used (or will use) your Gift Voucher contrary to these terms and conditions; or
12.8.3 we believe (or reasonably suspect) that there is an error with your Gift Voucher.
12.9 Liability
12.9.1 You are responsible for use and safety of your Gift Voucher and are liable for all transactions made using your Gift Voucher.
12.9.2 Subject at all times to the exceptions in clause 10.3:
12.9.3 we are not liable to you for any loss or damage (whether direct, indirect, consequential or special) either in negligence, tort, breach of contract, breach of warranty or for any other reason or cause whatsoever, arising out of or in connection with a Gift Voucher, these terms and conditions or your use of the Website, including any loss or corruption of data, interference with or damaged to your computer or any interruption, delay or failure of the Website; and
12.9.4 you agree to indemnify us against any claim, damages or expenses we suffer in connection with the use of your photo, including any infringement of another person’s intellectual property rights or unauthorized use of any image of any other person.
12.9.5 The exclusion of our liability and indemnity in clause 10.2 only applies to the extent permitted by law. Where consumer protection legislation implies any condition or warranty that cannot be excluded in these terms and conditions, we limit our liability for breach of any such implied conditions or warranties to re-supply of the services (or cost thereof). Any liability we have to you will be reduced by the extent (if any) to which you caused or contributed to the loss or damage. This clause 9 will apply even after this agreement has ended.
12.10 Relationship with us
12.10.1 Gift Vouchers may be used as personal or business gifts but must not be used in connection with any marketing, advertising or other promotional activities (including without limitations to websites, internet advertisements, email, telemarketing, direct mail, newspapers and magazine advertisements, and radio and television broadcasts) unless you obtain our prior written approval. Gift Vouchers that are used in marketing, advertising or other promotional activities in breach of this clause 10.1 will be invalid with the result that Recipients of those cards will not be able to use or Redeem unspent value on their Gift Vouchers.
12.10.2 Use of our name or brands, or any names, logos or get-up of Gift Vouchers (other than in connection with the purchase or use of Gift Vouchers), is strictly prohibited.
12.10.3 You must not use a Gift Voucher in any manner that states or implies that any person, website, business or product or service is endorsed or sponsored by or otherwise affiliated with us or any of our subsidiaries or affiliates.
12.11 Errors and complaints
12.11.1 If you have questions or if you wish to make a complaint about your Gift Voucher, contact us via:
a) Using the ‘Contact us’ section of the Website; and/or
b) Messaging us on Facebook; and/or
c) Sending us an email on accounts@krcustomservices.com.
